Terms of Sale

These Terms of Sale ("Terms") apply to all purchases of products (including prints and art) from Just as Beautiful Imagery, LLC ("us," "we," or "our") made via the justbeautiful.art website. By placing an order, you agree to these terms and conditions. Please review these terms carefully before submitting your order.

 

All sales are final. Exceptions are granted only for items that are lost or damaged during shipping, as detailed in the Damaged or Lost Shipments section below.

 

1. Pricing, Payment, and Order Acceptance

Pricing and Payment: All prices listed on www.justbeautiful.art are subject to change without prior notice. Payment must be made in full at the time the order is placed.

 

Order Acceptance and Cancellation by Us: Your receipt of an order confirmation does not signify our final acceptance of your order. We reserve the right to accept, decline, or limit your order for any reason (including, without limitation, stock shortages or pricing errors). In the event we cancel an order, we will issue a full refund to your original payment method.

 

2. Print Quality, Resolution, & Watermark

We primarily use the OM-1 Mark II camera. The optimal native maximum resolution for printing at 300 DPI (standard quality for close inspection) without cropping is 12x16 inches. For specific, static subjects like landscapes, we can utilize high-resolution modes to achieve prints at 300 DPI up to 18x24 or even 24x30 inches. We are also able to accommodate prints up to 30x45 inches. These larger sizes are printed at approximately 200 DPI, which is considered a typical and high-quality resolution for wall art viewed at a distance. While we employ advanced processing techniques to minimize noise and pixelation, please be advised that printing above the native resolution may cause these artifacts to be noticeable upon close inspection of prints larger than 12x16 inches.

 

The portfolio includes images captured with various equipment, including the Google Pixel 6 and the older Olympus Evolt E-500. For these specific images, we recommend producing prints no larger than 6x9 inches (Pixel 6) and 8x10 inches (E-500) to maintain a true 300 DPI quality standard.

 

Please be aware that some prints have been artistically cropped. Cropping lowers the total number of pixels in the source image, which reduces the recommended maximum print size.


We add a small watermark on all photos before uploading them to our Pixieset web hosting service. Pixieset adds an additional, larger watermark. The Pixieset watermark is not included in any prints or digital downloads. Notices by Pixieset referring to watermarks being removed or no watermark will be used only refer to the Pixieset watermark. It does not refer to the watermark applied to the original photo by us.

 

We strongly encourage you to contact us prior to purchase if you have any quality concerns. We are happy to confirm the source image resolution and optimal print size for your intended use. We offer watermark-free prints for an additional fee and they must be purchased by directly contacting us.

 

3. Copyright and Ownership

The sale of any physical print or digital file does not transfer the copyright in the work to the buyer. Just as Beautiful Imagery, LLC retains all copyright and reproduction rights to the artwork.

 

The sale of any physical product, including Prints, Wall Art, Cards, Albums, and any other products listed for sale, is intended for personal, private display only. Any commercial use, public display, resale, or reproduction of the image (including scanning, photography, or digital sharing) is strictly prohibited without a separate, written commercial license agreement from us. Displaying the print in a commercial setting, such as a business office, lobby, or retail space, constitutes commercial use and is prohibited under this agreement.

 

4. Shipping Policy

All purchases are drop-shipped through one of Pixieset's affiliated print services (WHCC, ProDPI, Millers, or Mpix). Processing, shipping, and costs are dependent on the print service used, your shipping address, and your shipping preference.

 

Delivery Estimates: The total time to receive your order is Processing Time + Shipping Time. Any delivery dates provided are estimates only and not guaranteed. We are not liable for delays caused by the carrier, holidays, inclement weather, or other factors once the order has left the print service provider. Orders are not processed or shipped on weekends or holidays.

 

5. Damaged or Lost Shipments

Claims Process: Always contact us first if your package is damaged or appears lost. All shipments are insured, and we will file the claim on your behalf. Do not attempt to file a claim directly with the carrier—doing so may void the insurance policy. Refunds or replacements are issued pending your full cooperation during the claims process.



For Missing Shipments: We must file the claim within 30 calendar days of the shipment date. You may be required to sign an affidavit once the claim process begins.

 

For Damaged Shipments: You must notify us within 10 calendar days of delivery.

Save all original packaging materials and damaged goods for evidence.

You will be required to provide photos of damaged items and both inner and outer packaging.

 

Do not release any products or packaging to any other entity before consulting with us. Doing so risks invalidating the claim and your ability to receive a refund or replacement.

 

When an insurance claim is filed, both Just as Beautiful Imagery, LLC and you, the recipient, acknowledge your respective responsibilities. Both parties agree to cooperate in good faith to provide any necessary items within the time frame stipulated by the insurance coverage. Should either party be unwilling or unable to fulfill the duties necessary for a successful claim approval, they may be liable for any losses not recovered.

 

6. Digital Product Sales and Licensing

Any purchase of a digital image file through www.justbeautiful.art is subject to the following conditions:

  • Final Sale: Due to the nature of digital files, all sales are final and non-refundable, without exception.
  • Licensing vs. Ownership: Digital files are licensed, not sold. The purchase grants the Licensee only a limited, non-exclusive, non-transferable right for personal use.
  • Binding Agreement: By completing a purchase of a digital file, the Licensee acknowledges and agrees to be bound by the full terms of the separate Digital Image License Agreement (Personal Use), which is hereby incorporated by reference into these Terms of Sale.
  • Copyright Retention: Just as Beautiful Imagery, LLC retains all copyright and intellectual property rights in the image, and the Licensee is strictly prohibited from using the image for any commercial purpose, resale, or redistribution.

 

7. Governing Law and Limitation of Liability

Governing Law: These Terms shall be governed and construed in accordance with the laws of the State of Missouri, United States, without reference to conflict of laws principles.

 

Limitation of Liability: By purchasing our products, you agree that the total and exclusive liability of Just as Beautiful Imagery, LLC arising from any product sold on this website shall be limited to the purchase price of the product ordered. In no event shall we be liable for any special, indirect, punitive, or consequential damages.

 

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 15 days' notice prior to any new terms taking effect. By continuing to make purchases after any revisions become effective, you agree to be bound by the revised terms.

 

9. Disclaimer of Warranties

Except as expressly provided in this Terms, all products and digital filed are provided “as is” and “as available,” without any warranties of any kind, either express or implied. Just as Beautiful Imagery LLC disclaims all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Some states do not allow limitations on implied warranties, so these limitations may not apply to you.

 

10. Force Majeure

Just as Beautiful Imagery LLC shall not be liable or deemed in default for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, fire, flood, natural disasters, war, terrorism, labor disputes, governmental actions, or interruptions in internet or shipping services.

 

11. Entire Agreement and Severability

These Terms of Sale, together with the Digital Image License Agreement (Personal Use) and our Privacy Policy, constitute the entire agreement between you and Just as Beautiful Imagery LLC regarding your purchase. If any provision of these terms is found invalid of unenforceable, the remaining provisions shall remain in full force and effect.
